1. Introduction
These Terms of Service ("Terms") govern your access to and use of the DoNotes website and application ("Service"). Please read these Terms carefully. They include important information about your legal rights and obligations.
2. User Registration and Accounts
Local Plan: Users of the Local plan do not need to register. All data is stored locally on the user’s device.
Basic, Advanced, Premium Plans: Registration is required. We collect the following personal information:
- Display names
- Usernames
- Emails
3. Subscription Plans
Please note that not all subscription plans may be available.
Local Plan (Coming Soon): Data is stored exclusively on the user’s device.
Basic, Advanced, Premium Plans: Data is synchronized with DoNotes servers. Feature availability and pricing details are subject to change. Changes will be communicated as follows:
- Feature Removals or Pricing Changes: Users will be notified 2 months in advance for any removals or pricing changes (up or down).
- New Features: Notifications will be sent immediately.
4. Data Privacy and Security
- Data Protection: We use encryption to protect user data stored in our databases. User data is not shared with third parties, except as required by law.
- WebRTC and YJS: Live collaboration sessions use YJS for secure synchronization.
- Local Plan: No online data storage. General usage analytics may be monitored using PostHog.
5. User Account Management
- Account Settings: Users can manage their account settings, including subscription details and personal information, via the settings menu in the app.
- Password Recovery: Users can use the "forgot password" link on the sign-in page to reset their passwords.
6. Content Ownership and Licensing
- User Content: Users retain ownership of their content.
- Marketplace Publications: By publishing content in the DoNotes marketplace, users grant DoNotes a non-exclusive, royalty-free license to use, display, and distribute such content for promotional purposes, with appropriate attribution.
7. User Conduct
Users agree to use DoNotes in a lawful and ethical manner. Prohibited content and behaviors include, but are not limited to:
- Illegal Content: Including pirated software, illegal drugs, or stolen intellectual property.
- Hate Speech: Promoting violence or discrimination based on race, religion, nationality, gender, sexual orientation, or disability.
- Harassment: Any form of bullying, threats, or abusive language.
- Explicit Content: Pornographic material, graphic violence, or sexually explicit content.
- Spam: Unsolicited advertisements or deceptive practices.
- Misinformation: False or misleading information.
- Self-Harm or Suicide: Content promoting or depicting self-harm or suicidal behavior.
- Personal Information: Unauthorized sharing of personal or confidential information.
- Malware: Content that contains harmful software.
- Impersonation: Pretending to be someone else.
- Fraudulent Activity: Content promoting scams or phishing.
- Violence and Threats: Incitement or threats of violence.
- Substance Abuse: Content promoting illegal drug use or any alcohol consumption.
- Terrorism: Supporting or promoting terrorism and violations of international and humanitarian laws.
- Copyright Violation: Unauthorized use of copyrighted material.
- Unauthorized Access: Content promoting hacking or unauthorized system access.
- Inappropriate Behavior: Any content disrupting community well-being.
Child Protection:
- Child Exploitation: No content exploiting or abusing minors.
- Sexual Content Involving Minors: Strictly prohibited.
- Child Abuse: Content depicting or discussing abuse of children is forbidden.
- Grooming and Endangerment: Content promoting grooming, predatory behavior, or dangerous activities is not allowed.
- Inappropriate Language: Offensive or harmful language aimed at minors is prohibited.
- Personal Information of Minors: Sharing or soliciting personal details of minors is banned.
- Unsupervised Communication: Features that facilitate unsupervised interactions with minors are restricted.
- Educational and Parental Controls: Content bypassing parental controls is not allowed.
8. Service Availability and Uptime
- Uptime Guarantee: DoNotes guarantees a minimum uptime of 98%. Details can be found on status.donotes.app.
- Partial Refunds: If we do not meet the 98% uptime guarantee, a partial refund may be issued.
- Global Availability: DoNotes may not be available in all regions. Countries violating international laws may be blacklisted.
9. Changes to Terms of Service
- Notification: Users will be notified via email of changes to these Terms. Users must accept the updated Terms upon their next login.
10. Refunds and Cancellations
- Cancellation Policy: Users can cancel their subscription within the first 15 days of each month to receive a refund for that month.
- Post-Cancellation: Accounts will be downgraded to the free plan. Users who exceed the free plan limits will not be able to create new notes but can edit existing ones.
11. Liability and Disclaimers
- Data Loss: DoNotes is not liable for any loss of data. Users are responsible for backing up their data.
12. Dispute Resolution
- Resolution Process: We aim to resolve disputes amicably without legal proceedings. However, if a user violates these Terms, DoNotes reserves the right to terminate their account.
13. Intellectual Property
- Ownership: DoNotes retains ownership of all intellectual property, including trademarks, copyrights, and patents.
- User-Generated Content: Users retain ownership of their content but grant DoNotes a license to use published content for promotional purposes.
14. Third-Party Services and Links
- Third-Party Apps: DoNotes includes vetted third-party applications available in the marketplace.
- External Links: Links to third-party content are provided for convenience. DoNotes is not responsible for issues arising from interactions with third parties.
- Service Providers: DoNotes uses third-party services such as Cloudflare, Vercel, IONOS and Clerk for user authentication. We are not liable for issues with these services.
15. Changes to Features and Functionality
- Feature Changes: Users will be notified 2 months in advance of feature removals or pricing changes. New features will be announced immediately.
16. User Feedback
- Submission: Users are encouraged to submit feedback via email at info@donotes.app or through forms and support tickets within the app.
17. Legal and Regulatory Compliance
Compliance Measures: DoNotes complies with applicable data protection laws, including GDPR and CCPA. Measures include:
- Data Protection: Robust encryption and security measures.
